Probationl: Final phase of serving a sentence

Parole is the final step in serving a sentence in Spain. It is a prison benefit that allows an inmate to complete their sentence outside of prison, under certain conditions and supervision. If you or a family member are close to reaching this stage, it is essential to know the requirements and how to properly apply for it.

What is parole?

Conditional release consists of the early release of a convicted person, allowing them to complete their sentence in freedom, provided they meet certain conditions. Although it is not an acquittal, it does represent recognition of the inmate’s progress in social reintegration.

The remaining sentence continues to be counted, and if the convicted person violates the imposed rules, they may return to prison.

Requirements for access to parole

Not all inmates are eligible for this measure. The main requirements for parole in Spain are:

  • Having served three-quarters of their sentence (except for exceptions due to serious illness or special cases).
  • Being classified as a third-grade prisoner.
  • Having demonstrated good conduct and an active attitude toward reintegration.
  • Having a favorable report from the Treatment Board.
  • Submitting a life plan for freedom (residence, work, family environment).

Special cases with early access

In some cases, it is possible to obtain parole before serving three-quarters of the sentence:

Very serious illness with incurable conditions

If the inmate suffers from a terminal or very serious illness, he or she may access this benefit for humanitarian reasons.

Inmates over 70 years old

Depending on the individual's personal situation and progress within the facility, early release may be considered.

Who decides on the granting of parole?

The prison’s Treatment Board proposes the grant, and the Penitentiary Supervision Judge makes the decision. If there is opposition or doubt, the intervention of a lawyer specializing in penitentiary law can be decisive.

What conditions must a prisoner on parole meet?

The person granted parole is subject to a series of legal obligations until the end of their sentence:

  • Refrain from committing new crimes.
  • Report their situation periodically.
  • Maintain a stable residence.
  • Participate in specific programs if required.
  • Agree to be supervised by prison social services.

Failure to comply may result in revocation of parole and immediate return to prison.
